Terms and Conditions

These Terms and Conditions govern the relationship between AZ I TI Ltd. and the users of the Blink Kids online store at detskimagazin.eu. By ticking the consent box when placing an order, the customer confirms that they have read, understood and accept these Terms and Conditions. This English text is a translation; in case of discrepancy, the Bulgarian version prevails, without prejudice to any mandatory consumer protection rules that apply to you.

2. Definitions

• "Trader" — AZ I TI Ltd..

• "Consumer" / "Customer" — any natural person who concludes a contract with the Trader for purposes outside their trade, business or profession.

• "Online Store" — the website detskimagazin.eu and the related checkout page at secure.detskimagazin.eu.

• "Product" — goods offered for sale in the Online Store.

• "Distance Contract" — a contract of sale concluded through the Online Store without the simultaneous physical presence of the parties.

3. Scope

These Terms and Conditions apply to all contracts for the sale of Products concluded through the Online Store and form an integral part of each such contract. Each order is governed by the version of these Terms and Conditions in force at the time it is placed.

The Online Store is intended for customers aged 18 or over. By placing an order, the Customer confirms that they are of legal age and have full legal capacity.

4. Products and information

The main characteristics of each Product — design, colour, available sizes, materials and care instructions — are set out on the Product page.

The Products are a limited edition and are available in limited pieces per size. Availability is updated automatically, but where orders are placed simultaneously a Product may sell out after an order has been submitted. In that case the Trader will inform the Customer and refund all payments in full.

Photographs are for illustration purposes. Minor colour differences caused by lighting during photography or by the Customer's screen settings may occur and do not constitute a lack of conformity.

The Customer is responsible for choosing the size of the Product. A size chart and sizing guidance are available on the website, and the Customer may consult the Trader before ordering. An unsuitable choice of size does not constitute a lack of conformity with the contract.

5. Prices

Prices are stated in euro (EUR) and are final, including all taxes where applicable.

The delivery charge is not included in the Product price. It is shown separately on the checkout page before the order is confirmed and is payable by the Customer.

The Trader may change prices at any time. Changes do not affect orders already placed. In the event of an obvious technical pricing error, the Trader will notify the Customer, who may either confirm the order at the correct price or cancel it and receive a full refund of all payments.

6. Orders and conclusion of the contract

The Customer selects a Product and size, adds it to the cart and proceeds to the checkout page, where they enter their delivery details and choose a payment method. Before confirming, the Customer can review the order and correct any input errors.

By clicking the button to complete the order, the Customer makes an offer to conclude a contract that involves an obligation to pay.

After the order is submitted, the Customer receives an automatic email acknowledging receipt. The contract is concluded when the Trader sends confirmation that the order has been accepted or dispatches the Product, whichever occurs first.

The Trader may decline an order where the Product is out of stock, the details provided are incomplete or incorrect, or there is a reasonable suspicion of misuse, in which case it will notify the Customer and refund all payments in full.

The contract is concluded in Bulgarian. The order details are stored by the Trader and sent to the Customer by email.

7. Payment

The available payment methods are shown on the checkout page. Card payments are processed by a licensed payment service provider. The Trader does not receive or store the Customer's card details.

Where cash on delivery is chosen, the Customer pays the order value and the delivery charge to the courier upon receipt of the parcel.

8. Delivery

Delivery is made by courier to the address provided by the Customer, in the countries available at checkout. The price, method and estimated delivery time are shown on the checkout page.

Delivery times are estimates. If the Trader is unable to fulfil the order within 30 days of the conclusion of the contract, the Customer may terminate the contract and receive a refund of all payments.

Risk of loss of or damage to the Product passes to the Customer when the Customer, or a third party indicated by them other than the carrier, acquires physical possession of the Product.

On receipt, the Customer should inspect the parcel in the presence of the courier. Visible damage to the packaging or the Product should be recorded in a report with the courier. This does not limit the Customer's rights in the event of a lack of conformity.

If the Customer fails to collect or refuses to accept the parcel without having exercised the right of withdrawal, the Trader may terminate the contract and retain or claim from the Customer the actual costs of delivering and returning the parcel.

9. Right of withdrawal

The Customer has the right to withdraw from the contract within 14 days of receiving the Product without giving any reason, under Articles 50 – 57 of the Bulgarian Consumer Protection Act.

The direct cost of returning the Product is borne by the Customer. Due to the delicate nature of the garments and the protective packaging they require, this cost may be significant.

The Customer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

The detailed conditions, the procedure for exercising the right of withdrawal and the model withdrawal form are set out in the Returns Policy, which forms an integral part of these Terms and Conditions.

10. Legal guarantee and complaints

The Trader is liable for any lack of conformity of the Product with the contract of sale that becomes apparent within two years of delivery, in accordance with the Bulgarian Act on the Supply of Digital Content and Digital Services and the Sale of Goods. This liability does not depend on any commercial guarantee.

In the event of a lack of conformity, the Customer may request that the Product be brought into conformity by repair or replacement or, where this is impossible or disproportionate, a proportionate price reduction or termination of the contract, as provided by law.

Complaints may be submitted by email to office@detskimagazin.eu or in writing to the Trader's address, stating the order number, a description of the lack of conformity and the remedy requested, with photographs where possible. The Trader records the complaint in its complaints register, provides the Customer with its reference number and responds within the time limits set by law.

Where a complaint is justified, the cost of returning and redelivering the Product is borne by the Trader.

The following do not constitute a lack of conformity: an unsuitable choice of size; wear and tear from normal use; damage caused by failure to follow the care instructions, by incorrect washing, ironing or storage, or by mechanical impact after delivery.

11. Product safety

The dresses include decorative elements — such as lace, bows and, on some designs, feathers — which may present a choking hazard if detached. The child must wear the Product under adult supervision. Do not leave the child unsupervised with the Product, including while sleeping.

Before each use, check that the decorative elements and seams are intact. Do not use the Product if any element is loose or detached.

Follow the care instructions stated in the Product description.

12. Intellectual property

The content of the Online Store — texts, photographs, graphics, logos, trade marks and the design of the Products, including the Blink signature lace — is protected by intellectual property rights. Any use without the prior written consent of the rights holder is prohibited.

13. Liability

The Trader is not liable for damage caused by force majeure, by the acts of third parties, including couriers and payment service providers, or by incorrect or incomplete information provided by the Customer.

Nothing in these Terms and Conditions excludes or limits the Customer's rights under mandatory consumer protection law.

14. Personal data

The Trader processes Customers' personal data in accordance with Regulation (EU) 2016/679 and the Privacy Policy published in the Online Store.

15. Dispute resolution and governing law

The Trader aims to resolve all disputes amicably. The Customer may contact the Trader at office@detskimagazin.eu.

The Customer may file a complaint with the Bulgarian Commission for Consumer Protection (www.kzp.bg) or refer the dispute to an alternative dispute resolution body, including the sectoral conciliation committees at the Commission for Consumer Protection. For cross-border disputes within the EU, the Customer may contact the European Consumer Centre Bulgaria (www.ecc.bg).

Matters not covered by these Terms and Conditions are governed by Bulgarian law. This choice of law does not deprive a consumer habitually resident in another country of the protection afforded by the mandatory provisions of the law of that country. Disputes not resolved amicably are referred to the competent court.

16. Amendments

The Trader may amend these Terms and Conditions by publishing the new version in the Online Store. Amendments do not affect contracts concluded before their publication.
